Many property owners are being assessed at levels well above market value, often due to recent economic circumstances. Another reason for this phenomenon is that large single-tenant buildings, particularly “mega” distribution warehouse facilities, have a tendency to have market values significantly less than the development costs (developed due to the value of the facility to the owner’s business plan), yet assessors have a tendency to equate cost to market value. Mr. Kilpatrick has been successful negotiating with various assessors (resulting in significant decreases in assessed value), and has also been successful in subsequent legal proceedings (district court trials) when county officials have been unwilling to recognize the reality of cost versus market value. One client is currently saving more than $200,000 per year as the result of a recent property tax lawsuit and trial.
